COMMONWEALTH FINANCIAL LAW

With strengths in: establishment and maintenance of trusts, finance banking law, financial governance, financial regulation and management issues, fraud, defective administration, insurance/indemnities/guarantees, loans and financial arrangements, mortgages and other charges, and securities.

AGS has a comprehensive knowledge of the legal issues that govern Australian Government financial transactions. We also appreciate that the Australian Government in its financial transactions is subject to different requirements of accountability from those applicable in the private-sector, including requirements such as Australian National Audit Office review of transactions, ministerial responsibility to Parliament and scrutiny of expenditure by parliamentary committees.

Our lawyers are comfortable and experienced at operating within the Commonwealth financial management and accountability framework. AGS was the legal adviser to the Department of Finance and Administration in relation to the drafting of the Financial Management and Accountability Act 1997 and the Commonwealth Authorities and Companies Act 1997 and subsequent amendments to that legislation.

We also have a great deal of expertise in the application of the Commonwealth financial framework to commercial transactions. For example, we have extensive experience in major purchases and acquisitions ranging from information technology networks to buildings. AGS contributed to the development of the Australian Government’s general procurement guidelines and information technology procurement policies and has experience in devising creative but legally sound and publicly accountable approaches to problems and difficulties.

Advice can be provided on taxation issues from a constitutional, statutory and financial perspective or alternatively from a strategic or litigation perspective.

Our lawyers also have particular expertise on insurance matters and can provide advice on your insurance as well as the insurance responsibilities of non-Australian Government organisations operating within the Australian Government environment. AGS acted as solicitors assisting the HIH Royal Commission.
