and services tax, tax investigation and review, and tax
liability.
Our national tax practice provides a full range of legal
services, across Australia, to the Commissioner of Taxation
concerning the general administration of tax legislation.
These services include:
- advice on liability to all types of tax, for example
income tax, goods and services tax, fringe benefits tax,
superannuation charges and surcharges, and pay-as-you-go
remittance and instalment liabilities
- tax appeals in the Administrative Appeals Tribunal,
the Federal Court and the High Court
- recovery of all types of tax debts, including: litigation
in the state, local or magistrates courts, District or
County Courts and Supreme Courts; striking out defences;
setting aside default judgments; settling statements
of claim; obtaining Mareva injunctions and the appointment
of receivers; advising on statutory garnishee notices,
for example section 260–5 notices; advising on
and defending claims by liquidators to recover alleged
unfair preference payments; advising on and initiating
claims against directors to recover indemnities in respect
of unfair preferences; recovery of incorrect refunds;
advising on director penalty matters and preference matters;
and advising on the enforcement of judgments generally
- administrative law challenges under the Administrative
Decisions (Judicial Review) Act 1977 and other
jurisdictions, involving, for example, access and evidence
gathering, the Taxation Relief Board, departure prohibition
orders, extensions of time, commencement of recoveries,
declaratory proceedings and statutory garnishee notices
- tax investigations, for example access and evidence
gathering under sections 263 and 264 of the Income
Tax Assessment Act 1936, privilege questions, searches
and expert opinions
- secrecy and privacy issues, complaints to the Ombudsman
and matters under the Freedom of Information Act 1982.
AGS also provides tax law services to a range of Commonwealth
agencies, particularly in relation to compliance issues.
