REGULATION AND ENFORCEMENT
Bodies administering regulatory schemes rely on AGS lawyers
to advise them on the use of their powers to assist them
with investigations and resulting enforcement action. This
work ranges from undertaking civil enforcement and recovery
action to quasi-criminal penalty matters. Major clients
include the Australian Taxation Office, the Australian
Customs
and Border Protection Service, and the Australian Competition and Consumer Commission.
Investigatory work undertaken by regulatory and law enforcement
agencies often gives rise to difficult issues concerning
the exercise of intrusive or coercive powers. AGS has extensive
experience in advising on obtaining and executing search
or seizure warrants and similar coercive notices as well
as in relation to the protection and use of information
obtained through such powers. We also have significant
experience in defending legal and other challenges to
a regulatory
body’s use of its powers.
