AGS has acted in a large number of claims for compensation under the Compensation for Detriment caused by Defective Administration (CDDA) scheme. We have advised various agencies on the circumstances in which act-of-grace payments may be made under s 33 of the PGPA Act, including the interaction between act of grace and ex gratia payments.
Our experience includes providing a team of outposted lawyers to the Australian Taxation Office (ATO) to assist in resolving claims against the ATO under the CDDA scheme. The claims covered a range of technical areas, from the administration of audits through to workers’ compensation and employment law. A highlight was the mediation of a $7 million claim against the ATO.
