Civil enforcement practice
AGS has an unparalleled depth of experience in advising on pecuniary penalty proceedings and other civil enforcement options for Commonwealth agencies. We have been central to the establishment of the law in this area, right across the Commonwealth regulatory environment. We can provide truly national coverage, with lawyers in each capital city experienced in advising on and conducting civil penalty proceedings. We have experts in all areas of this work, from devising, drafting and implementing new civil enforcement regimes through to counsel who have appeared in and solicitors who have conducted many precedent setting cases.
Typically, enforcement regimes provide the flexibility to choose from a variety of sanctions – ranging from administrative action (such as enforceable undertakings, infringement notices, disqualifications and licence suspensions) to seeking relief from the courts (including declarations, injunctions, pecuniary penalties, the imposition of compliance programs or orders for redress). Our practitioners have the experience to advise on the conduct of enforcement investigations before proceedings commence, so that our clients can determine the most appropriate enforcement tool to be applied to the case at hand.
