Thy is an experienced lawyer with over 20 years of experience, providing clients with strategic, timely and cost-effective solutions, across a range of common law claims. She has achieved many successful outcomes in contested proceedings, at informal settlement conferences and in mediations.
Thy is currently responsible for the supervision of a large portfolio of personal injury claims made by former detainees at the Commonwealth's former immigration and reception processing centres located in South Australia. These claims raise a range of complex issues related to the Commonwealth's legal duties, contribution from third party service providers, limitation periods and causation in respect of damages.
Thy's recent experience includes:
- supervising a large portfolio of Comcover negligent misstatement, negligence and breach of statutory duty claims spanning back to the early 1960s that often raised complicated statutory interpretation, limitation period and damages issues
- resolving a multi-million dollar damage claim for CSIRO, which involved multiple parties, complicated questions of proportionate liability, vicarious liability and properly recoverable damages
- assisting the Department of Defence in a catastrophic personal injury matter resulting in the payment of many millions of dollars, as well as related nervous shock claims filed by the plaintiff's family
- advising and conducting claims involving allegations of negligence, breach of statutory duty, false imprisonment and malicious prosecution against the Australian Federal Police.
